Veteran’s widow sues, claims VA failed to diagnose late husband’s lung cancer in timely manner

The widow of a Thompsonville, IL veteran has filed a lawsuit against the Veterans Administration (VA). The widow, representing herself, alleges that the Marion VA Hospital, in Marion, IL, failed to diagnose her late husband’s lung cancer in a reasonable amount of time.

The lawsuit, filed in the U.S. District for Southern Illinois on April 27, 2016 and written in all capital letters states, “My name is Raina S. Campbell, I am asking to bring this case because of the failure of Marion VA doctors to diagnose my husband’s (Danny Campbell) lung cancer in a timely manner, that we could have treated him at earlier stage.” Mrs. Campbell’s lawsuit is seeking $40 million dollars.

According to the obituary, her late husband, Danny Campbell, died on January 28, 2013 at 9:12 p.m. at Barnes-Jewish Hospital in S. Louis. He was 63 years old and a U.S. Marine Corps veteran of the Vietnam War.

The Public Affairs Officer at the Marion VA Hospital, Beth Lamb, has declined to comment, stating, “The VA cannot discuss pending litigation.”

The complaint says that in November of 2009, 60 year old Danny Campbell began to cough up large amounts of blood. He was taken to the Marion VA Hospital emergency room. After arriving, Mr. Campbell underwent various procedures, including x-rays and scans. The person who performed the scans allegedly stated that it appeared to him that Mr. Campbell had cancer. Despite this, the doctors diagnosed Danny Campbell with a lung infection.

Raina Campbell complaint says, “Doctor told me to make sure to get him to a hospital right away if [he] started coughing up blood in big amounts.”

Although it’s not mentioned in the lawsuit, there is a patient record for Danny Campbell at Memorial Hospital of Carbondale that is attached to the complaint as an exhibit. The patient record indicates that Mr. Campbell was taken to the emergency room by a family member on November 18, 2009 on the recommendation of the VA hospital. The patient record also shows that the Memorial Hospital of Carbondale treated Danny Campbell for symptoms similar to those that were treated by Marion VA Hospital.

The complaint continues, as Mr. Campbell’s symptoms and his condition grew worse, he was seen by Marion VA Hospital doctors in Marion and St. Louis numerous times, receiving medication and various tests while his health continued to decline. Raina Campbell’s complaint states, “People that seen him day to day said he did not look well,” Raina Campbell said in her complaint. In late 2012, a biopsy turned up a slow moving stage 3 cancer.”

After the cancer diagnosis, Mr. Campbell went through more tests, scans, radiation and chemotherapy. Despite this, his condition continued to decline and he was eventually admitted to the Marion VA Hospital where he was diagnosed with two bleeding brain tumors. Mr. Campbell died the following January.

Raina Campbell says, in the final part of her complaint, “By time Marion VA told us there was a problem, lung cancer, it was all ready to late. Even if he had not lived a long time, we had that chance to try and get some more time, or stop it. This is why I am filing this case.”
