Construction Accident Lawyers - Sarasota, Bradenton, Punta Gorda, Tallahassee
The construction industry is one of the largest employers in the U.S., providing jobs to millions of hard working people. On a daily basis, carpenters, electricians, plumbers, engineers, architects and many other construction workers are working under dangerous conditions. In many cases, without the required safety devices or around improperly maintained equipment. In fact, construction is one of the most dangerous jobs to have in Florida, ranking at the top or near the top of work related injuries and fatalities every year. From 2007 to 2011, 747 workers in Florida lost their lives due to a construction accident, thousands more were injured.

Typical construction sites will use a variety of general contractors, sub-contractors and third party companies to complete the project. Depending on the circumstances of the construction accident, one or more of these parties can be held liable for any injuries or deaths that occur on the job site. Because of this, determining liability for a construction accident can be difficult.

For 25 years, the Florida construction accident lawyers of Lutz, Bobo & Telfair, P.A. have protected the legal rights of injury victims and their families. Our firm offers no cost initial consultations for all construction accident related injuries. We all take all construction accident cases on a contingency basis. This means you owe not attorney’s fees unless we settle your case or win a favorable verdict in court.

Construction Accident Common Causes

According to the Occupational Safety and Health Administration (OSHA), over 50% of all construction site fatalities are caused by the “Fatal Four”. The “Fatal Four” include, electrocution, falls, being struck by an object or caught in between / crushed by heavy objects. Of the “Fatal Four”, falls are the leading cause of death and injury on sites, accounting for one third of all construction accident fatalities. Despite falls being the leading cause of death and injury among construction workers, lack of fall protection was the most commonly cited OSHA safety violation in 2015. In addition to fall related injuries and death, OHSA lists scaffolding as the second most cited construction related safety violation in 2015.

Why is this important to your claim? Employers are responsible for ensuring the workplace is safe and meets OSHA regulations. In most cases, the company owners or supervisors will treat construction accident related injuries as a workers’ compensation claim. While workers’ compensation can be a valuable resource, it typically falls short of covering the full extent of the damages suffered by the worker.

If it can be proven that the employer or another third party were in some way responsible for the construction accident related injury or death, they can be held accountable for all or a portion of the resulting damages. This can allow for a much greater level of compensation than the typical workers’ compensation claim. Filing a claim against a third party may allow you to recover damages for full lost wages (past and future), lost earnings potential, pain and suffering, additional medical expenses, and in severe cases punitive damages. None of which can be obtained under a workers’ compensation claim.

If you have been seriously injured or lost a loved one in a construction accident, we offer no cost initial consultations. We also take all injury cases on a contingency basis. This means you owe absolutely no attorney’s fees unless we settle your case or win a favorable judgement in court.
